I have tried a fresh install and have not done the wizard. in order to isolate the issue. the unit itself DOES have access to the internet. I can browse outside of XBMC as well as download the APK to get a sept 22 build of xbmc for Ouya. the issue is not my connectivity on my network the issue is definitely with XBMC.

Running the XBMC Linux build for this does not get you a full install of linux (no web browser, no gui, nothing). You can SSH in, but the filesystem layout is very weird. I ended up getting a Chromecast in addition to this to stream most of my internet media, and I use XBMC on the Pivos for local media. XBMC Log Oddly too, the weather service function does work, but it does not find any add-ons. Under Network Information it says Link: Connected, MAC address is blank but occassionaly flashes something, and Internet: Not Connected. Check network settings. Thanks for the help. So I had to explore other options that were within my limit and that was to check whether the repository I was trying to install is down or not. Always remember to check your time and date settings if you're having internet issues. It may well be that you have a different issue but this is always the best thing to check If you did not have to assign an IP address to your computer chances are that you do not have to worry about changing anything within XBMC for your xbox to have access your network and the internet.
